ORDER TO SHOW CAUSE: Plaintiff is ORDERED to show cause why this action should not be DISMISSED for failure to prosecute pursuant to Federal Rule of Civil Procedure 41(b) by filing a written response with the Clerk of Court within TWENTY-ONE (21) DAYS of the date of this Order. ORDER directing Plaintiff to submit an amended complaint within 30 DAYS of the entry date of this order. Plaintiff is DIRECTED to: (1) draft his amended complaint on the complaint form provided by the Clerk of this Court. Plaintiff must, also within 30 DAYS of the date of this order, either submit the full filing and administrative fee of $400.00, or execute and return a personally signed financial affidavit seeking leave to proceed in forma pauperis that includes (1) a completed certificate signed by an authorized institutional officer regarding the current balance in his inmate account and (2) a copy of his inmate trust account balance for the six-month period preceding the filing of the instant action. Plaintiff is CAUTIONED that, even if to proceed in forma pauperis, pursuant to 28 U.S.C. 1915(b)(1), he must nevertheless pay the full amount of the $350.00 filing fee from his prisoner account. If plaintiff does not want to have the funds deducted from his account, he should file a notice voluntarily dismissing this action within 30 days of the entry date of this order. The Clerk of the Court is DIRECTED to stamp the civil action number on a standard 42 U.S.C. 1983 civil action form and forward the form and the appropriate financial affidavit to plaintiff, together with a copy of this Order. The Clerk is further DIRECTED to resubmit this action to the assigned Magistrate Judge upon receipt of the amended complaint and full filing and administrative fee or affidavit or at the expiration of the time period noted above.
