Filing 3 ORDER - Plaintiff, Manuel A. Gonzalez, III, confined in the R. J. Donovan Correctional Facility in San Diego, California, has submitted a pro se civil complaint #1 without prepaying the $350.00 filing and $50.00 administrative fees that are required for civil actions and without applying for in forma pauperis status.1 If Plaintiff wishes to proceed without prepayment of the filing and administrative fees, he must provide a properly completed financial affidavit and certified prison account statement as instructed further below. Plaintiff is cautioned that, even if he is allowed to proceed in forma pauperis, pursuant to 28 U.S.C. 1915(b)(1), he nevertheless must pay the full amount of the $350.00 filing fee from his prisoner account. If Plaintiff does not want to have funds deducted from his prison inmate account, he should file a notice stating that he voluntarily dismisses this action. If Plaintiff does not choose to voluntarily dismiss this action, IT IS ORDERED that Plaintiff must, within THIRTY (30) DAYS of the entry date of this Order, pay the $400.00 filing and administrative fees or properly execute and return the financial affidavit form provided by the Clerk of Court. During the pendency of his case, Plaintiff must keep the Clerk of Court advised of his correct address at all times. Plaintiff is admonished that this action shall be subject to dismissal if he fails (1) to pay the fee or submit the required affidavit within the specified period of time (2) to keep the Clerk of Court advised of his current address at all times while this action is pending. The Clerk of this Court is DIRECTED to forward Plaintiff a financial affidavit form. The Clerk is further DIRECTED to RESUBMIT this action to the undersigned Magistrate Judge upon the expiration of the aforementioned time period. Signed by Magistrate Judge Catherine M.
