March 2, 2020 Opinion or Order Filing 4 ORDER: This case comes before the Court on a frivolity determination pursuant to 28 U.S.C. 1915(e)(2). On February 27, 2020, Magistrate Judge Russell G. Vineyard granted Plaintiff in forma pauperis status for the purpose of allowing a frivolity determination. Plaintiff previously brought identical claims against Defendant Emory Hospital in another lawsuit, which the Court dismissed for failure to state a claim pursuant to 28 U.S.C. 1915(e)(2)(B)(ii). See Howe v. Emory Hospital, No. 1:19-CV-05760-LMM (N.D. Ga. Feb. 19, 2020). Because Plaintiff raises no new claims against Defendant, the Court dismisses this action for the reasons stated in the Courts previous order. See id. The Clerk is DIRECTED to DISMISS this action WITHOUT PREJUDICE as failing to state a claim upon which relief can be granted. The Clerk is DIRECTED to CLOSE this case.
