ORDER: Before the Court are Defendants' motions to dismiss. One issue the parties did not address is whether Georgia law permits the recovery of lost profits as a measure of damages for a new business. The resolution of this question may be relevant to whether Plaintiff has sufficiently alleged damages to support the Court's jurisdiction in this matter. Because federal courts are under an independent obligation to examine their own jurisdiction, the parties are DIRECTED to submit supplemental briefs of no more than five pages answering this question by March 1, 2021.
