The plaintiff additionally asks the court to grant him subpoena power to allow him to substantiate his claims. Such request is premature because the plaintiff has not yet been allowed to proceed on his claims. Notably, the recommendation of dismissal by the magistrate judge is not based on lack of evidence to substantiate claims. Rather it is based on a legal analysis of the type of claims the plaintiff seeks to raise.
