Filing 32 ORDER: In Defendants' Motion to Dismiss for Lack of Jurisdiction #3 , Defendants argued that the Texas court, not this Court, lacked personal jurisdiction. That Motion is therefore DENIED as moot without prejudice to any jurisdictional arguments relevant to this Court. As to McKesson's individual Motion, Plaintiff acknowledged McKesson's subject-matter jurisdiction argument in her Motion to Transfer. See Dkt. No. #22 at 3. She stated that she does not oppose McKesson Corporation's motion. Id. Accordingly, Defendant McKesson Corporation's Motion to Dismiss for Lack of Subject Matter Jurisdiction #10 is GRANTED as unopposed. The Clerk is DIRECTED to terminate Defendant McKesson Corporation as a Defendant in this case. Signed by Judge Leigh Martin May on 8/26/2020. (tmf) |
