The undersigned RECOMMENDS that Plaintiff's Motion to Remand ([Doc. #8 ]) be DENIED. See 28 U.S.C. 1446(b)(2)(C). As an ancillary matter, the undersigned notes that several moot motions have been pending since this case was in Clayton County Superior Court. Fist, Plaintiff moved to stay the proceedings over five months ago to clarify facts and circumstances and proper parties. [Doc. #2 at 2]. Pretermitting whether a stay was ever justified in the first place, the motion appears to be moot because Plaintiff has twice since amended the complaint, adding new factual allegations and parties. [Docs. #5 , #6 ]. Accordingly, the undersigned RECOMMENDS that Plaintiff's Motion to Stay ([Doc. 2]) be DENIED as moot. Second, Defendant Clayton County moved to dismiss Plaintiff's initial Complaint or, in the alternative, for a more definite statement. As just mentioned, Plaintiff filed subsequent amended complaints, and thus the undersigned RECOMMENDS that the Motion to Dismiss ([Doc. #3 ]) likewise be DENIED as moot.
