Filing 15 ORDER granting #14 Motion to Stay. Before the Court is the parties Joint Motion to Stay Discovery (Doc. #14 ). Plaintiffs The Luo Group LLC (Luo) and Godfrey Tago and Defendants SC Apartments LLC and Landlocked, LLC (together, the Corporate Defendants) request that the Court stay discovery pending the appearance of Defendant Andrew Perkel, who is currently scheduled to file an answer on or before September 1, 2021. By local rule, discovery is scheduled to commence thirty days after the appearance of the first defendant by answer or motion. See LR 16.2, NDGa. However, a magistrate judge has broad discretion to stay discovery pending decision on a dispositive motion. Panola Land Buyers Assn v. Shuman, 762 F.2d 1550, 1560 (11th Cir. 1985). The Corporate Defendants filed a motion to dismiss on July 21, 2021. (Doc. #10 ). Therefore, the parties' discovery plan is currently due on August 21, 2021, even though Defendant Perkel is yet to appear. The undersigned has reviewed the pending motion to dismiss, in which the Corporate Defendants challenge the complaint as a shotgun pleading and several counts for failure to state a claim, and agrees that discovery should be stayed pending its resolution. Accordingly, the parties' Joint Motion to Stay Discovery (Doc. #14 ) is GRANTED to the extent they seek a temporary stay, and the undersigned STAYS the case, sua sponte, until a final ruling on the motion to dismiss.
