ORDER - This matter is before the Court on Defendants' Motion for Reconsideration #8 , requesting that the Court modify its Order #7 compelling compliance with subpoenas issued to Usman Eshai, Ali Eshai, Najeeb Eshai, and Rubina Eshai. For the reasons set forth below, the Court GRANTS IN PART defendants Motion as to Usman Eshai, Ali Eshai, and Najeeb Eshai, who are now named parties in the parent action in the Eastern District of Pennsylvania. The Court GRANTS the Motion as to those three individuals and QUASHES their subpoenas in order for the Pennsylvania Court to govern discovery as to them. However, Rubina Eshai is still subject to the December 8, 2021 subpoena. (Pl.s Mot. to Compel Ex. A #1 , at 12-14.) The Court finds that compliance with the subpoena is required and that Rubina Eshai failed to timely object to its enforcement. Therefore, the Motion as to Rubina Eshai is DENIED. Given the nature of the documents to be produced, including tax returns, the parties agreed to file a protective order in this case. Accordingly, the parties are DIRECTED to file a protective order on or before April 1, 2022. Upon the filing of said protective order, Rubina Eshai is DIRECTED to produce the subpoenaed documents and sit for a deposition at a mutually agreed upon time. Signed by Magistrate Judge Walter E.
