March 22, 2023 Opinion or Order Filing 4 ORDER DISMISSING IN PART Plaintiff's complaint, as it pertains to the constitutional Bivens claims. Doc. No. #3 , 1012. Plaintiff's FTCA claim of wrongful death, however, survives the Court's frivolity review under 28 U.S.C. 1915(e). Accordingly, for the FTCA claim specifically, Plaintiff's application to proceed in forma pauperis is GRANTED IN PART. Doc. No. #1 . The Clerk is directed to send Plaintiff copies of the following forms: USM 285 form, summons, and the initial disclosures form, which are to be completed and returned to the Clerk for the Defendant within thirty (30) days from the entry date of this Order. Upon receipt of the completed forms, the Clerk is DIRECTED to prepare a service waiver package for the Defendant. In the event the Defendant does not return the Waiver of Service form to the Clerk of Court within thirty-five (35) days following the date the service waiver package was mailed, the Clerk is DIRECTED to prepare and transmit to the United States Marshals Service a service package for the Defendant.
