Filing 2 ORDER: The Clerk is therefore DIRECTED to ADMINISTRATIVELY CLOSE Hines III. IT IS THEREFORE ORDERED that Plaintiff's request for discovery is GRANTED. The scheduling order 24 is modified to provide for a two-month discovery period, which shall run from August 28, 2023, through and including October 30, 2023. Motions for summary judgment are due no later than November 30, 2023. The Clerk is DIRECTED to send Plaintiff two signed but otherwise blank Rule 45 subpoenas for Plaintiff to use for requesting documents or other information from any appropriate entity. Plaintiff is DIRECTED to fill out the subpoenas sent to him by the Clerk, to identify the person or entity to be subject to the subpoenas along with the full and correct service address, the caption of this case (Hines v. Perry, Civil Action No. 1:22-CV-4238-LMM-JSA), the information being demanded, and the other blank fields required to be filled in. If Plaintiff wishes for the Clerk and/or the U.S. Marshal to effectuate service of the subpoena pursuant to Plaintiff's in forma pauperis status, he must return the original and a copy with a request for service no later than twenty-one days from the date of this Order. Plaintiff is advised that while his in forma pauperis status entitles him to Court service of process, including a Rule 45 subpoena, it does not entitle him to have the Court bear other expenses and costs of discovery or to pay any witness fees that may be applicable. The Court warns Plaintiff that failure to comply in a timely manner could result in the dismissal of this action. The Clerk is DIRECTED to resubmit this action to the undersigned if Plaintiff fails to comply. IT IS ORDERED that Plaintiff's motion for appointment of counsel is DENIED at this time. If the Court determines, at a later point in the proceedings, that Plaintiff requires appointed counsel, it will reconsider Plaintiff's request. Signed by Magistrate Judge Justin S.
