ORDER: Plaintiffs' motion for issuance of "Doe" summonses [ECF 5] is DENIED without prejudice. The Eleventh Circuit Court of Appeals recognizes an exception to the prohibition against fictitious party pleading when "the plaintiff's description of the defendant is so specific as to be at the very worst, surplusage." Richardson v. Johnson, 598 F.3d 734, 738 (11th Cir. 2010). The Doe allegations in Plaintiffs Complaint do not meet this standard. Nevertheless, Plaintiffs are invited to file a motion under Fed. R. Civ. P. 26(d)(1) for early discovery concerning the true identity of each Doe Defendant. APPROVED by Judge Steven D. Grimberg on 09/06/2023. (slc)
