TEXT ORDER: On review of the briefing and the underlying case in the Northern District of Georgia, it appears that there would be exceptional circumstances that would support transfer of this Motion to the Northern District of Georgia under Federal Rule of Civil Procedure 45(f), in the interest of judicial economy, efficient case management, and the administration of justice, particularly given the potential for inconsistent orders from different district courts, the nature of the issues raised including management of the case, the parties, and counsel, the potential relevance issues requiring analysis of the substantive claims, the ongoing management of discovery in the Northern District of Georgia, and the lack of significant burden on the local nonparty SCSJ, which by its own assertion is already appearing in the Northern District of Georgia as counsel. The Court gives notice of its intent to raise this transfer issue sua sponte, and will allow the movant and any interested party until August 25, 2023 to be heard on this issue by filing a brief or position statement, with any replies due by August 31, 2023.
