ORDER TO SHOW CAUSE why this action should not be DISMISSED for failure to prosecute pursuant to Rule 41(b) by filing a written response with the Clerk of Court within TWENTY-ONE (21) DAYS of the date of this order. Plaintiff also shall file an amended pleading and either pay the applicable filing fee or submit a properly completed financial affidavit as previously ordered within TWENTY-ONE (21) DAYS of the date of this Order. Diarra is admonished that failure to respond within the specified period of time may result in the dismissal of this action pursuant to Local Rule 41.3(A)(2). Diarras motion requesting a trial #4 is DENIED as premature.
