Filing 2 FINAL REPORT AND RECOMMENDATION re #1 Complaint, filed by Moussa Diarra. It is RECOMMENDED that this action be DISMISSED WITHOUT PREJUDICE under 28 U.S.C. 1915(g). The Court now warns plaintiff regarding his abuse of this Court's resources. To date, plaintiff has filed fifty-five civil cases in this Court. He has now far exceeded his limit in free filings, yet he continues to clog this Court with his frivolous filings. The purpose of the three-strikes provision "is to curtail abusive prisoner litigation" and to "prevent prisoners from misusing the legal system." White v. Lemma, 947 F.3d 1373, 1376 (11th Cir. 2020). As plaintiff now has three strikes but continues to file cases, the Court deems it necessary to warn him, in the clearest terms possible, that his further abuse of the judicial process and waste of judicial resources will result in more harsh sanctions such as an outright ban on his filings. The Clerk is DIRECTED to terminate the referral to the Magistrate Judge. Signed by Magistrate Judge Linda T. Walker on 2/16/2024. (tmf) |
