April 17, 2024 Opinion or Order Filing 12 ORDER: The Court GRANTS IN PART AND DENIES IN PART the Parties' motion. #11 . Specifically, the Court GRANTS the Parties' motion insofar as the Court REFERS this case to Chief Magistrate Judge Russell G. Vineyard for assignment to the next available Magistrate Judge for the purpose of conducting mediation pursuant to Local Rule 16.7. See LR 16.7, NDGa. However, the Court DENIES the Parties' motion insofar as the Court declines to maintain this case on its active docket while the Parties participate in mediation. Instead, the Court DIRECTS the Clerk to ADMINISTRATIVELY CLOSE this case pending the outcome of the Parties' mediation. The Court ORDERS that the Parties update the Court, via a joint filing on the docket, of the outcome of their mediation no later than five (5) days after the date such mediation occurs. If mediation is successful, the Court ORDERS the Parties to file their proposed settlement agreement and joint motion for approval of the settlement agreement regarding Plaintiff Jennifer de la Torre's Fair Labor Standards Act claims no later than twenty-one (21) days following mediation. If mediation is unsuccessful, the Court ORDERS the Parties to move to reopen the case no later than five (5) days following mediation and ORDERS Defendants Andrea Hastings and Hastings Shadmehry, LLC to file a responsive pleading to the Complaint no later than ten (10) days after the date that mediation occurs.
