Filing 5 COMPLAINT with Jury Demand filed by John Doe. (Attachments: #1 Civil Cover Sheet)(rsg) Please visit our website at http://www.gand.uscourts.gov/commonly-used-forms to obtain Pretrial Instructions and Pretrial Associated Forms which includes the Consent To Proceed Before U.S. Magistrate form. |
Filing 4 ORDER granting #3 Application for Leave to Proceed in forma pauperis but his pleading has failed an initial frivolity review because it does not plausibly state a claim upon which relief may be granted. The Court DIRECTS the Clerks Office to send Plaintiff a copy via first-class mail of the Complaint Form for a Civil Case form. Using the Complaint Form, Plaintiff is ORDERED to file an amended complaint within TWENTY-ONE (21) DAYS of the entry of this Order, complying with these instructions. The Clerk is DIRECTED to resubmit this action to the undersigned if Plaintiff fails to comply. Signed by Magistrate Judge Regina D Cannon on 9/27/2024. (rsg) |
Clerk's Certificate of Mailing as to John Doe re #4 Order on Application for Leave to Proceed in forma pauperis. (rsg) |
Filing 3 APPLICATION for Leave to Proceed in forma pauperis by John Doe. (Attachments: #1 Proposed Amended Complaint, #2 Letter)(rsg) |
Submission of #3 APPLICATION for Leave to Proceed in forma pauperis, to Magistrate Judge Regina D Cannon. (rsg) |
Filing 2 ORDER denying #1 Application for Leave to Proceed in forma pauperis. If Plaintiff wishes to proceed, he is ORDERED to, no later than SEPTEMBER 2, 2024, either: (1) pay the full filing fee for this civil action, or (2) complete and file an amended IFP application and affidavit that provides any additional information he feels is necessary to establish his entitlement to proceed IFP in this action. Plaintiff is ADVISED that the failure either to pay the required filing fee or sufficiently show entitlement to proceed IFP will result in a recommendation that this case be dismissed. Separately, it appears that the allegations in Plaintiff's complaint are currently insufficient to state a plausible claim for disability discrimination. He should, therefore, take the opportunity to file a more detailed pleading on or before the date that he pays the filing fee or files an amended IFP application. Without more detailed and relevant allegations, he risks dismissal of this action even if he is granted leave to proceed IFP. See 28 U.S.C. 1915(e)(2)(B) (directing courts to dismiss IFP actions that are frivolous or fail to state a claim). The Clerk is DIRECTED to send Plaintiff a blank copy of the IFP application to the mailing address he provided. Signed by Magistrate Judge Regina D Cannon on 8/19/2024. (rsg) |
Clerk's Certificate of Mailing as to John Doe re #2 Order on Application for Leave to Proceed in forma pauperis, IFP form sent. (rsg) |
Filing 1 APPLICATION for Leave to Proceed in forma pauperis by John Doe. (Attachments: #1 Complaint, #2 Motion to proceed under pseudonym, #3 Civil Cover Sheet)(ajw) |
