Filing 35 ORDER granting 28 Motion for Leave to File Excess Pages. IT IS FURTHER ORDERED that Defendants Rule 12(b)(6) motion 29 is GRANTED IN PART and DENIED IN PART. Specifically the motion to dismiss is GRANTED as follows: Plaintiffs Fourth and Fourteen th Amendment claims are DISMISSED for failure to state a claim for relief. The GDOC, LASP Warden Howerton, LASP Deputy Warden Seabolt, LASP Legal Assistant Hampton, and LASP Health Services Administrator Stephen Davis are DISMISSED from this action. Plaintiffs First Amendment claim against Bracewell in her official capacity is DISMISSED. Plaintiffs request for punitive damages in connection with her First Amendment claim is DISMISSED. The motion to dismiss is DENIED in all other respects as Plai ntiff has stated a First Amendment claim seeking nominal damages against Bracewell in her individual capacity. IT IS FURTHER ORDERED that Defendant Bracewell shall file an Answer within 30 days of the entry date of this Order. Answer due 7/20/2009. I T IS FURTHER ORDERED that this case SHALL proceed on a 4 month discovery track, beginning 30 days after Defendant Bracewell files her Answer to the complaint, subject to extension by motion filed prior to the expiration of the discovery period.
