ORDER DIRECTING Plaintiff to file a Second Amended Complaint that incorporates all the causes of action against all the Defendants that Plaintiff wishes to pursue at this time within thirty (30) days of the date of this order. The Court will then r eview the Second Amended Complaint for frivolity and determine at that time which claims shall proceed. Plaintiffs 4 Motion to Certify Class Action is DENIED. Plaintiffs 5 Motion to Submit Documents Into Evidence is DENIED. Plaintiffs 8 10 20 and 28 motions which relate to an appeal of his medical certification are DENIED as MOOT. Since the Court is ordering Plaintiff to file a Seconded Amended Complaint in which Plaintiff can name all parties against which he is asserting a cla im, Plaintiffs 9 Motion to Add Parties and Plaintiffs 14 Motion to Dismiss Claims Against Defendant Moak are DENIED as MOOT. Since the FAA has filed a 25 Motion to Dismiss that is not within the Courts jurisdiction because the FAA is not a p arty to this action, the clerk is DIRECTED to terminate the motion 25 . The clerk is also DIRECTED to terminate Michael Huerta and the Federal Aviation Administration as parties to this action. Plaintiffs 17 18 and 30 discovery motions are DENIED as untimely. Plaintiffs 13 Emergency Motion to Appoint Counsel and Plaintiffs 19 Motion to Appoint Counsel are DENIED. Plaintiffs 21 Motion for Summary Judgment is DENIED as untimely. Plaintiffs 29 Emergency Motion for Declaratory Judgment is DENIED as MOOT. Plaintiffs 31 Motion for Alternative Service is DENIED as MOOT.Signed by Judge Richard W. Story on 7/11/2013. (vld)
