April 9, 2019 Opinion or Order Filing 75 ORDER: The parties asked the Court to decide three preliminary discovery issues before discovery requests have even been produced: 1) custodians subject to electronic discovery; 2) discoverability of evidence concerning Plaintiff Kermanis alleged forgery of Mr. Lillies signature; and 3) formatting of electronic discovery including metadata. At the conference, parties agreed that the relevant custodians are all parties in the action. Further, the Court finds that given the fraudulent allegations in the case, evidence of Plaintiff Kermanis alleged forgery is relevant and proportional. Concerns of fraud also entitle Defendants to comprehensive metadata with discovered documents. That said, the Court is mindful of cost, and it is difficult to determine more without a sense of how much discovery is at issue. Accordingly, once both discovery requests are produced, the Court directs Plaintiffs to provide Defendants with requested metadata, but Counsel should determine the details of the exchange. Counsel should negotiate in good faith to tailor the discovery to what is necessary and can be handled in a cost-effective fashion. The parties should meet and confer to discuss this issue as well as scheduling moving forward. If agreement can be reached, the parties should submit a consent scheduling order, within fourteen days.
