Filing 103 ORDER: The Dunn Plaintiffs Motion for Summary Judgment 70 is GRANTED; Columbias Motion for Summary Judgment 85 is DENIED; and Pattersons Partial Motion for Summary Judgment 59 is granted in part and denied in part. It is GRANTED as to Patterson s breach of contract claim (Count II) and Columbias duty to cooperate affirmative defense and is DENIED as to Columbias mitigation affirmative defense. This case will proceed on Plaintiffs negligent or bad faith failure to settle claim (Count III) and damages.
