Filing 4 ORDER: If Plaintiff wishes to proceed with this action, IT IS ORDERED that Plaintiff must, within THIRTY (30) DAYS of the entry date of this Order, either submit the full filing and administrative fees of $402.00 or execute and return a financial affidavit seeking leave to proceed IFP. Additionally, if Plaintiff wishes to proceed with this action, Plaintiff is ORDERED to submit an amended complaint within THIRTY (30) DAYS of the entry date of this Order. If Plaintiff does not wish to proceed with this action or does not wish to have funds deducted from his inmate account, he is INSTRUCTED that, within THIRTY (30) DAYS of the entry date of this Order, he should file a Notice of Voluntary Dismissal which clearly states that he voluntarily dismisses this action. The Clerk of Court is DIRECTED to (1) pre-stamp Amended Complaint / 2:21-CV-0022-RWS-JCF, on a copy of this Courts 1983 civil action form, (2) forward the form to Plaintiff, together with the appropriate financial affidavit and a copy of this Order, and (3) resubmit this action to the undersigned United States Magistrate Judge upon receipt of the amended complaint and completed financial affidavit or at the expiration of the aforementioned thirty-day time period.
