ORDER denying #5 Motion for Reconsideration. As an alternative, Plaintiff asks the Court to refund his filing fees. Ordinarily, the Court does not refund filing fees after dismissal. However, based on the allegations in the Motion, it appears that Plaintiff, who proceeded pro se, may well have qualified for in forma pauperis status. Accordingly, his Motion for a refund of fees is GRANTED. The clerk is DIRECTED to REFUND the filing fee paid by Plaintiff in this case. Signed by Judge Richard W.
