Roberts' cross-motion to quash the subpoena, [Doc. 2], is DENIED, and each party shall bear his own costs. Specifically, Jackson's motion to compel compliance with the defective subpoena that was never properly served is DENIED, but his motion for an alternative method of service of a properly issued subpoena is GRANTED. Therefore, the Court grants Jackson leave to serve Roberts with the properly issued deposition subpoena by sending the subpoena and witness fee to his last known address by certified mail or overnight service, with a copy of the subpoena provided by e-mail and first-class mail to Roberts' counsel, Mr. Rogers. At the conclusion of the evidentiary hearing, the Court directed counsel to confer about a date and location for Roberts' deposition should the Court grant Jackson's motion, and counsel have informed the Court that the deposition can take place on March 25, 2020, at 1:00 p.m. at the location agreed upon by counsel.
