ORDER directing that Plaintiff must amend his petition by naming his immediate custodian as the proper respondent. It is further ordered that he execute and return within 33 days, an Affidavit and Authorization allowing Custodian to withdraw funds from Inmate Account. The Clerk is directed to convert this matter into a 28 U.S.C. 2241 habeas corpus action and change the nature-of-suit code on the docket sheet accordingly. The Clerk shall stamp the civil action number on a copy of this Courts 28 U.S.C. 2241 habeas corpus form and forward the form and the appropriate financial affidavit to petitioner, together with a copy of this Order. The Clerk shall also resubmit this action to the assigned Magistrate Judge upon receipt of the amended petition and filing fee or affidavit or at the expiration of the time period noted above.Forms sent to party: Affidavit and Authorization; 28:2241 Forms.
