March 31, 2021 Opinion or Order Filing 57 ORDER Granting Defendant's #21 Motion to Transfer and Denying as Moot Plaintiff's #40 Motion to Certify Class. This case is TRANSFERRED to the United States District Court for the Northern District of Georgia. Unless and until ordered otherwise by the Northern District of Georgia, unexpired deadlines in this case (if any) continue to control. ORDERED by Judge William J. Martinez on 3/31/2021. (angar, ) [Transferred from Colorado on 4/1/2021.]
February 22, 2021 Opinion or Order Filing 56 ORDER. Before the Court is Defendants' Renewed Motion to Dismiss Plaintiff's Complaint ("Motion to Dismiss") #22 , in which Defendants incorporate by reference their arguments and citations of law raised in their Motion to Transfer, Or In the Alternative, Compel Arbitration #21 . In the Motion to Dismiss, Defendants' sole argument is that the Court lacks subject-matter jurisdiction over this matter, as the parties have agreed to binding and final arbitration of Plaintiff's claims. (ECF No. 22 at 1.) For support, Defendants cite one Northern District of Oklahoma case. (Id.) With this Motion to Dismiss, Defendants have made a cursory argument which they fail to properly develop for this Court's consideration. See United States v. Hunter, 739 F.3d 492, 495 (10th Cir. 2013) (cursory argument not meaningfully developed by any analysis or citation is deemed waived). The Motion to Dismiss, in incorporating all of the arguments in the Motion to Transfer, also appears duplicative of the Motion to Transfer. Under these circumstances, the Court DENIES the Motion to Dismiss #22 . SO ORDERED by Judge William J. Martinez on 2/22/2021. Text Only Entry(wjmlc1, ) [Transferred from Colorado on 4/1/2021.]
