ORDER TO SHOW CAUSE - This case is before the Court on its own Motion. Plaintiff New York Life Insurance Co. filed the instant Motion to Compel #1 on October 19, 2021. Attached to that Motion is a Certificate of Service which states that plaintiff's counsel electronically filed the foregoing with the Clerk of the Court using the CM/ECF system, which will send a notice of electronic filing to all counsel of record. (Id. at 28.) While Rule 5 permits service upon a party via their attorney and allows the use of the Court's electronic-filing system to serve a registered user, no attorney has made an appearance on behalf of defendant Misty Goss-McBrayer in this case and she is not a registered user of CM/ECF. The Court ORDERS plaintiff to serve defendant in accordance with Federal Rule of Civil Procedure 5 and Local Civil Rule 5.1 and to file proper proof of service upon her within FOURTEEN (14) DAYS of the date of this Order.
