MEMORANDUM DECISION AND ORDER granting in part and denying in part 13 Motion to Dismiss; Defendants motion to dismiss Muths § 1983 claims against the entity defendants, and against the officers in their official capacities, is GRANTED. Thes e claims (identified as Counts I through III of the complaint) are dismissed as to these defendants without prejudice. Plaintiff shall file any amended complaint within 30 days of this Order.
