Filing 42 MEMORANDUM AND ORDER RE: MOTION TO AMEND plaintiff's motion for leave to file an amended complaint is GRANTED. Plaintiff's motion for summary judgment on defendants' affirmative defenses is DENIED without prejudice. Defendants' motion for summary judgment on plaintiff's spoliation claim is DENIED AS MOOT without prejudice to later arguments concerning appropriate sanctions for spoliation of evidence. Plaintiff shall file an amended complaint within seven days of the d ate this Order is signed. The parties shall file a stipulation setting forth an amended discovery deadline and amended dispositive motions deadline, or a joint statement that they cannot agree on those dates, within fourteen days of the date this Order is signed.
