OPINION AND ORDER Regarding Plaintiffs' Motion to Amend Complaint, Defendant's Motion for Summary Judgment, and Defendant's Motion to Exclude Expert Testimony. The Glenns' 4/26/18, Motion For Leave To Amend Complaint To Include A Claim For Punitive Damages (docket no. 25 ) is denied as moot; B&R's 5/21/18, Motion For Summary Judgment (docket no. 28 ) is granted as to all of the Glenns' claims;B&R's 5/25/18, Daubert Motion In Limine To Exclude Engineer Stephen s (docket no. 29 ) is granted; and B&R's 6/22/18, Request For Judicial Notice (docket no. 39 ) is granted. Because summary judgment in favor of B&R has been granted as to all of the Glenns' claims, the trial in this matter is cancelled, and judgment shall enter accordingly. Signed by Judge Mark W Bennett.
