September 4, 2019	Filing 7 SECOND ORDER OF CONSOLIDATION and ORDER REQUIRING CONSOLIDATED AMENDED PETITION. Case No. 1:19-cv-00264-BLW, is CONSOLIDATED with the other above-captioned cases for all purposes. The earliest-filed case, Byerly v. Idaho, Case No. 1:19-cv-00130-BLW, will continue to be the lead case. Petitioner is reminded that all filings for these four consolidated cases must be filed in the lead case only. Any document filed in a consolidated case that does not include Lead Case No. 1:19-cv-00130-BLW may be summarily denied, stricken from the record, or returned to Petitioner unfiled. Because Petitioner has filed more than one amended petition in these consolidated cases, he has violated the Court's Order of Consolidation dated July 15, 2019. The Court will grant Petitioner one final opportunity to file an amended petition, under 28 U.S.C. 2241, that includes all habeas claims challenging his pending state criminal charges in Ada County Case No. CR01-19-05242. Petitioner's final amended petition must be filed within 21 days after entry of this Order and must be entitled, "Consolidated Amended Petition." Petitioner may not file any new habeas corpus action challenging the same pending state criminal charges until these consolidated cases are finally adjudicated. Any new habeas case filed in violation of this Order may be summarily dismissed. Signed by Judge B. Lynn Winmill.
