MERIT REVIEW--THIRD AMENDED COMPLAINT entered by Judge Joe Billy McDade on 4/16/2020. IT IS THEREFORE ORDERED: 1. This case shall proceed on the claims that Defendants Dronenberg, Frazier and Caudle exerted unconstitutional against Plaintiff. All o ther allegations are DISMISSED for failure to state a claim pursuant to Fed. R. Civ. P. 12(b)(6) and 28 U.S.C. § 1915A. Defendants Toppel and Sorensen are DISMISSED. The Doe Defendants #1-#5 are DISMISSED as Plaintiff has identified the forme r Doe Defendants in his third amended complaint. Warden Melvin is also DISMISSED as he was named a Defendant in the Court's May 29, 2019 order merely to aid in identifying the Does. No other claims will be included in the case, except in the Court's discretion upon motion by a party for good cause shown, or by leave of court pursuant to Federal Rule of Civil Procedure 15.
