TEXT ORDER entered by Judge Colin Stirling Bruce on 3/18/2019. Plaintiff has clarified his intentions by filing a motion to dismiss his lawsuit. #11 ; see March 13, 2019 Text Order. It is difficult to decipher some of the Plaintiff's reasons for dismissing his case, but Plaintiff says he never intended to file a lawsuit in the Central District of Illinois. Therefore, he asks the Court to dismiss his case without prejudice. Plaintiff does have the option to discontinue this litigation. Therefore, Plaintiff's motion to voluntarily dismiss this case is granted pursuant to Federal Rule of Civil Procedure 41(b). #11 . The pending motion for appointment of counsel is denied as moot. #5 . In addition, since Plaintiff did not intend to open a lawsuit, the Court will waive collection of the filing fee. The March 13, 2019 order granting leave to proceed IFP is vacated. No fee will be collected. The Clerk is to send a copy of this order to the Trust Fund Office at Plaintiff's facility.(JS, ilcd) |

VACATED PURSUANT TO TEXT ORDER ENTERED 3/18/2019. TEXT ORDER entered by Judge Colin Stirling Bruce on 3/13/2019. Plaintiff has filed a motion to vacate. #6 . The motion is denied with leave to refile for clarification. #6 . If Plaintiff wishes to dismiss his case, he must file a motion to dismiss within 14 days. Given the early stages of this litigation, the Court will dismiss without accessing a filing fee and will refund any fees collected. If Plaintiff does not file a motion to dismiss within 14 days, the Court will assume Plaintiff does intend to pursue this litigation. In the meantime, Plaintiff's petition for leave to proceed in forma pauperis is granted #1 . Pursuant to 28 U.S.C. Section 1915(b) (1), Plaintiff is assessed an initial partial filing fee of $17.17. The agency having custody of Plaintiff is directed to forward the initial partial filing fee from Plaintiff's account to the Clerk of Court. After payment of the initial partial filing fee, the agency having custody of Plaintiff shall make monthly payments of 20 percent of the preceding month's income credited to Plaintiff's account to the Clerk of Court. Income includes all deposits from any source. The agency having custody of the plaintiff shall forward these payments each time Plaintiff's account exceeds $10, until the filing fee of $350 is paid in full. Plaintiff is admonished he is responsible for the full payment of the $17.17 initial partial filing fee. If Plaintiff has not made this payment within 21 days of this order, his case may be dismissed. The Clerk is directed to mail a copy of this order to Plaintiff's place of confinement, to the attention of the Trust Fund Office(JS, ilcd) Modified on 3/18/2019 (JS, ilcd). |
