TEXT ORDER entered by Judge Harold A. Baker on 1/21/2021. Plaintiff's motion for a substitute of judge is denied as moot #22 . This case has been reassigned within the district. Plaintiff also asks the Court to transfer his case back to the Northern District of Illinois since Defendant Dr. Timothy McGorsie is a Chicago resident #22 . The Northern District of Illinois considered Plaintiff's claim before transferring this case to the Central District on December 29, 2020. "The complaint's allegations almost exclusively to events that have occurred during Plaintiff's incarceration at Pontiac. Regardless of whether venue lies in this District due to Plaintiff naming UIC University of Illinois at Chicago as a defendant, the appropriate course is to transfer this suit to the Central District of Illinois." See 28 U.S.C. 1404(a), 1406(a). December 28, 2020, Order, citing 28 U.S.C. 1404(a), 1406(a). Therefore, the motion to transfer this case back to the Northern District of Illinois is also denied. TEXT ORDER entered by Judge James E. Shadid on 1/7/2021. Plaintiff's petition for leave to proceed in forma pauperis is granted #11 . Pursuant to 28 U.S.C. Section 1915(b) (1), Plaintiff is assessed an initial partial filing fee of $1.83. The agency having custody of Plaintiff is directed to forward the initial partial filing fee from Plaintiff's account to the Clerk of Court within 30 days of this order. After payment of the initial partial filing fee (or immediately if no funds are available for that payment) the agency having custody of Plaintiff shall make monthly payments of 20 percent of the preceding month's income credited to Plaintiff's account to the Clerk of Court. Income includes all deposits from any source, including gifts. The agency having custody of the plaintiff shall forward these payments each time Plaintiff's account exceeds $10, until the filing fee of $350 is paid in full. Plaintiff is ultimately responsible for ensuring that the initial partial filing fee and required monthly payments are made. Failure to do so may result in dismissal of this case. The Clerk is directed to mail a copy of this order to Plaintiff's place of confinement, to the attention of the Trust Fund Office, and to Plaintiff. (SAG, ilcd) |
