July 10, 2023 TEXT ORDER by US Magistrate Judge Karen McNaught on July 10, 2023: A scheduling conference was held pursuant to Rule 16 of the Federal Rules of Civil Procedure. The parties indicated they have met and conferred on ESI and protective orders and do not need further deadlines to file proposed orders. The Scheduling Order is as follows: Initial Disclosures due July 14, 2023; service of initial infringement contentions due July 15, 2023; service of initial invalidity and noninfringement contentions due August 18, 2023; deadline to join parties and amend pleadings is August 18, 2023; service of identification of claim terms requiring construction due September 1, 2023; meeting of the parties to confer on final list of disputed contentions on September 6, 2023; briefs and appendix on opening claim construction to be filed by October 13, 2023; response briefs to claim construction arguments to be filed by November 8, 2023; reply briefs to claim construction arguments to be filed by November 22, 2023; joint claim construction chart to be filed by November 29, 2023; claim construction hearing on January 11, 2024; final infringement and invalidity contentions to be filed by April 15, 2024; final noninfringement contentions to be served on May 15, 2024; close of all fact discovery on June 14, 2024; initial expert reports for issues on which the party bears the burden of proof to be served by July 15, 2024; rebuttal expert reports for issues on which a party does not bear the burden of proof to be served by August 30, 2024; depositions of experts to be completed by October 31, 2024; Final Pre-trial Conference is set before Judge Sue Myerscough on January 6, 2025, at 2:00 p.m.; trial is set on the trailing trial calendar of Judge Myerscough on January 21, 2025, at 9:00 a.m. Motions to compel and other motions relating to discovery shall be pursued in a diligent and timely manner, but in no event filed more than 60 days following the event that is the subject of the motion. The parties are required to meet and confer on the discovery dispute as required by Rule 37(a) within the 60-day period. Except for good cause shown, any discovery motion that is not timely filed or filed after the discovery deadline will not be considered by the Court. If a motion to compel discovery is found by the Court to be time-barred, the moving party is prohibited from making a subsequent request for the discovery which the Court has found to be time-barred. All motions to compel must contain the certification required by Rule 37 that the parties met and conferred and attempted to resolve the dispute. If the certification is not included, the motion will be denied. Telephone status conferences are set before Judge McNaught on September 7, 2023, at 10:00 a.m.; December 4, 2023, at 10:00 a.m.; June 18, 2024, at 10:00 a.m.; and October 4, 2024, at 10:00 a.m. The Court will place the telephone status calls.(GL)
