Plaintiff filed a Motion to Re-Open or Reconsider #8 asking the Court to reconsider and reopen this case, alleging delay at the prison in processing his request to pay the filing fee. Plaintiff has since paid the filing fee in full. Plaintiff's motion #8 is GRANTED. The Court's judgment #6 is VACATED. The Court finds that Plaintiff is not indigent for purposes of 28 U.S.C. 1915. Plaintiff's petition to proceed in forma pauperis #2 is DENIED. Plaintiff shall pay the $405.00 filing fee in full within 21 days of this Order. Failure to do so will result in dismissal of this case without prejudice. (SAG)
