TEXT ORDER entered by Judge Colin Stirling Bruce on 1/22/2021. Plaintiff's motion for reconsideration #7 is DENIED. Plaintiff argues that the Court erred in denying his motion to reduce or to waive the reduced filing fee because he did not drain his account before filing this lawsuit because he had no intention of filing this suit when he received the stimulus check under the CARES Act. However, Plaintiff states in his motion to reconsider that the first alleged violation that formed the basis for this suit occurred on October 25, 2020. Plaintiff withdrew $700.00 from his account only four days prior, and more importantly, he did not withdraw the remaining stimulus funds until mid-November, after the alleged violation occurred. Therefore, Plaintiff had the money necessary to pay the filing fee when the allege violations occurred. Again, Plaintiff is a frequent filer, and he knows of the required filing fee. Therefore, Plaintiff's motion to reconsider is denied. (KE, ilcd)

TEXT ORDER entered by Judge Colin Stirling Bruce on 1/11/2021. This Court has instituted a reduced filing fee procedure for indigent plaintiffs who are institutionalized but who are not prisoners as defined in 28 USC Section 1915(h). A reduced payment will be assessed of 50% of such plaintiff's average monthly income for the six months preceding the filing of the complaint (not to exceed the $402 filing fee). Income includes all deposits from any source. Plaintiff Terry C Johnson is currently detained at Rushville Treatment and Detention Facility, and is thus subject to the reduced payment procedure. Plaintiff's ledgers for the past six months show an average monthly income of $204.68. Plaintiff is ordered to send an institutional check or money order in the amount of $102.34, payable to Clerk, U.S. District Court within 30 days from the date of this order. The reduced fee may be waived if the plaintiff, within 14 days of this order, files a motion to waive the fee and demonstrates good cause for such waiver. (KE, ilcd)
