TEXT ORDER entered by Judge Colin Stirling Bruce on 10/18/2022. Plaintiff's motion for extension of time #18 is GRANTED, and Plaintiff has up to and including November 21, 2022, within which to pay the filing of $402.00 in this case. Plaintiff's motion for an Order from the Court #19 is also GRANTED. Accordingly, the trust fund office at the East Moline Correctional Center is ORDERED to process and to pay the $402.00 filing fee in this case from Plaintiff's prison trust fund account on or before November 21, 2022. If the trust fund office cannot or does not believe that this payment can be processed from Plaintiff's prison trust fund account by this deadline, the trust fund office must file a statement or notice with the Court informing the Court why the payment cannot be processed by this deadline. Plaintiff is ORDERED to sign any and all documents or releases that are required by the trust fund office at the East Moline Correctional Center so that they may timely process the payment of his filing fee. Finally, the Clerk of the Court is directed to send a copy of this Order to the trust fund office at the East Moline Correctional Center. (KE) |

TEXT ORDER entered by Judge Colin Stirling Bruce on 10/13/2022. Plaintiff's motion for reconsideration #16 is DENIED. Plaintiff does not ask the Court to take any specific relief in his motion. Regardless, Plaintiff's prison trust fund ledger shows that he has the funds necessary to pay the $402.00 filing fee, in full, and therefore, reconsideration is not warranted. The Court gave Plaintiff until October 17, 2022, by which to pay the filing fee. If he needs additional time to pay the filing fee, Plaintiff can file a motion asking for additional time. If Plaintiff does not timely pay the filing fee in full or ask for additional time, the Court will dismiss this case. Once Plaintiff pays the filing fee, the Court will consider and will rule upon his motion for leave to file an amended complaint. (KE) |

TEXT ORDER entered by Judge Colin Stirling Bruce on 9/26/2022. Plaintiff's motion for the Court's assistance #13 is DENIED. Plaintiff has filed the instant motion asking the Court for direction in filing an amended complaint. The Court cannot provide legal advice to litigants who appear before it, nor can the Court assist either Party in litigating their case. Southall v. AVI Food Sys., Inc., 2022 WL 1015001, * 3 (N.D. Ind. Apr. 5, 2022)(holding that "the Court cannot give a litigant legal advice."). Therefore, to the extent that he is asking the Court for legal advice, Plaintiff's motion is denied. However, the Court recognizes that Plaintiff is proceeding pro se, and therefore, the Court informs Plaintiff that he may seek leave to file an amended complaint now, but the Court will not consider this request until he pays the filing fee as directed by the Court in a separate Order. In fact, the Court may dismiss this case if he does not timely pay the filing fee in full. (KE) |
