MERIT REVIEW ORDER entered by District Judge Jonathan E Hawley on 5/21/2025. IT IS THEREFORE ORDERED: According to the Court's Merit Review of Plaintiff's Complaint under 28 U.S.C. 1915A, this case shall proceed on a Fourteenth Amendment deliberate indifference claim against (1) Defendants Dr. Osumdson and Mills based on the alleged denial of a bottom bunk permit on April 1, 2025, and (2) Defendants Paula Lodge, Curtis Parsons, Gerald Carreon, Natalia Bygrave, Elanor Schupick, McKenzy, Therapist John Doe, Therapist Jane Doe, Rooming Committee Member John Doe, and Rooming Committee Member Jane Doe based on their alleged decision to assign him to a room where he would be required to sleep in the top bunk on or about April 4, 2025. Additional claims shall not be included in the case above, except in the Court's discretion on motion by a party for good cause shown under Federal Rule of Civil Procedure 15. Plaintiff's Renewed Motion for Leave to Proceed in forma pauperis #7 is GRANTED. Defendants Wexford Corp and The Rooming Committee are DISMISSED WITHOUT PREJUDICE for failure to state a claim pursuant to Federal Rule of Civil Procedure 12(b)(6) and 1915A. The Clerk is DIRECTED to terminate these Defendants. The Clerk is directed to set an internal court deadline 60 days from the entry of this Order for the Court to check on the status of service and enter scheduling deadlines.(JS)

TEXT ORDER: This Court has instituted a reduced filing fee procedure for indigent plaintiffs who are institutionalized but who are not prisoners as defined in 28 USC Section 1915(h). A reduced payment will be assessed of 50% of such plaintiff's average monthly income for the six months preceding the filing of the complaint (not to exceed the $405 filing fee). Income includes all deposits from any source. Plaintiff Jon Canada is currently detained at Rushville Treatment and Detention Facility, and is thus subject to the reduced payment procedure. Plaintiff's ledgers for the past six months show an average monthly income of $25.00. Plaintiff is ordered to send an institutional check or money order in the amount of $12.50, payable to Clerk, U.S. District Court within 30 days from the date of this order. The reduced fee may be waived if the plaintiff, within 14 days of this order, files a motion to waive the fee and demonstrates good cause for such waiver. ( Prisoner Prepayment due by 6/8/2025). TEXT ORDER entered by District Judge Jonathan E Hawley on 4/24/2025. Plaintiff has filed a Motion for leave to proceed in forma pauperis ("IFP") that is insufficient as it is lacking information and is unsigned. Plaintiff's IFP motion is therefore denied #4 . Plaintiff is required to disclose all of his assets to the Court if he wishes to proceed IFP. Therefore, he must complete the IFP form and indicate any money he has received including gifts from family or friends. Plaintiff must also indicate if he has any outside accounts.
