Defendant reported that a decision on whether to file a certiorari petition has not been made. Defendant then sought to vacate the trial date due to a conflict with the March 5 schedule, specifically, one of the defendants has out-of-country plans. But in advance of the status hearing at which the trial date was entered, the Court had specifically required the parties to be prepared to discuss trial availability. R. 293. So the belatedly-raised schedule conflict is insufficient good cause to reset the date. Nor did defense counsel raise the issue with Plaintiff's counsel before today's hearing; Plaintiff's counsel first learned of the conflict at the podium. Having said that, the Court has reconsidered whether the March trial date is sensible in light of the likelihood that a cert petition, if filed, will not have been resolved by that date (or even if resolved, would be so close to the trial date that the parties will have expended effort on trial preparation, effort which would be wasted if the cert petition is granted). In order to help in setting a sensible trial date, Defendant shall file by 10/23/12 an estimated timeline of events if a cert petition is filed (including response and reply briefing, and listing for conference). The Court requests that the Illinois Solicitor General's Office assist in making these estimates. During the hearing, the Court mistakenly stated that the cert deadline is in mid-December; defense counsel correctly stated that the 90-day deadline (which runs from the 08/17/12 mandate/judgment issuance) expires on or around 11/15/12. The pretrial conference and trial date is stricken. Plaintiff's oral request to continue the trial subpoenas to the new trial date is granted. Defendants cited cases arguing that a stay is mandatory, but it appears that those cases involved staying discovery during the pendency of motions to dismiss raising qualified immunity, or staying trial during the pendency of summary judgment motions raising qualified immunity (and associated appeals), but not a situation where the interlocutory appeal has already affirmed the denial of qualified immunity. Nor did Defendants file a motion to stay the mandate in the Seventh Circuit. However, Defendants are free to make a formal motion to stay, with supporting authority, and Plaintiff might also wish to consider the wisdom in preparing for trial if a cert petition is indeed filed. But given the age of the case, it is appropriate to set the trial date--the longer the Court waits to do that, the deeper into 2013 the trial date will be, which prejudices Plaintiff. The status report mentions the possibility of a certiorari petition, which implies that Defendants will ask for a stay of the case if they file a cert petition. But Defendants did not file a motion to stay the mandate with the Seventh Circuit, so it seems that whether to stay the litigation is a decision within the district court's discretion (perhaps there is case law in the qualified immunity context that alters the exercise of discretion, and the Court welcomes any arguments Defendants wish to present on that issue). Chang: During the Court's deliberation over the pending summary judgment motion, the Court has had occasion to review the holding by the previously-assigned judge to the effect that, although the ADEA does not preclude a section 1983 action for age discrimination under the equal protection clause, qualified immunity renders the individual defendants not liable for money damages under section 1983. Mem. Op. at 20. But the application of qualified immunity to this context -- that is, the context of whether a section 1983 action is precluded by another federal statute -- appears unprecedented. When determining whether qualified immunity applies to protect a defendant, the question typically is whether a reasonable official would have known that the official was violating a clearly established constitutional right, which is a substantive question, not a question concerning whether a particular procedural vehicle (i.e., cause of action) is available. Furthermore, in cases where the Supreme Court has held that a federal statute does not preclude a 1983 action to bring a constitutional claim, the Court does not seem to ask whether qualified immunity applies, even if lower courts had debated whether the 1983 action was precluded. E.g., Fitzgerald v. Barnstable Sch. Comm.,555 U.S. 246, 129 S. Ct. 788, 898 (2009) (holding that Title IX is not the exclusive federal remedy for a gender discrimination claim in schools, and then remanding for an evaluation of the merits of the constitutional claim (equal protection) with no further discussion of whether qualified immunity applied to the procedural cause of action question). On or before March 9, 2011, the parties should file supplemental memoranda addressing the question of whether the doctrine of qualified immunity applies at all to preclusion questions such as whether the ADEA precludes a section 1983 action.
