ORDER: Plaintiff's application for leave to proceed in forma pauperis #3 is granted. The Court orders the trust fund officer at Plaintiff's place of incarceration to deduct $10.85 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee, and to continue making monthly deductions in accordance with this order. The Clerk of Court shall send a copy of this order to the trust fund officer at the Lawrence Correctional Center. Plaintiff's complaint, however, is dismissed on initial review pursuant to 28 U.S.C. 1915A for failure to state a cognizable federal claim. If Plaintiff wishes to proceed with this lawsuit he must: (1) explain in writing why this suit should not be dismissed as barred by the statute of limitations; and (2) submit an amended complaint, if he can do so consistent with Federal Rule of Civil Procedure 11, that states a cognizable federal claim. Failure to comply with both of these directives by December 10, 2018, will result in dismissal of this lawsuit. The Clerk is directed to send a copy of this order to Plaintiff, along with an amended civil rights complaint form and one blank USM- 285 (Marshals Service) form. The Court advises Plaintiff that a completed USM-285 form is required for service on each Defendant. The U.S. Marshal will not attempt service on a Defendant unless and until the required form for that Defendant is received. Signed by the Honorable Robert M. Dow, Jr on 11/5/2018. Mailed notice.
