Filing 13 ORDER signed by the Honorable Edmond E. Chang. For the reasons stated in the Order, Plaintiff's application to proceed in forma pauperis #11 is granted. The Court orders the trust fund officer at Plaintiff's place of incarceration to deduct $18.12 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee and to continue making monthly deductions in accordance with this order. The Court directs the Clerk of Court to (1) send a copy of this order electronically (if possible) to the trust fund officer at Plaintiff's present place of incarceration, and (2) file Plaintiff's complaint #1 . Summonses, however, shall not issue at this time. The Court, on reconsideration of Plaintiff's motion for attorney representation, requests that Alison Jameen Baldwin, McDonnell, Boehnen, Hulbert & Berghoff, Ltd., 300 South Wacker Drive, 32nd Floor, Chicago, Illinois 60606, tel.: (312) 913-0001, represent Plaintiff in accordance with counsel's Trial Bar obligations under the District Courts Local Rule 83.37. Recruited counsel is within the class of users listed in the Electronic Public Access fee schedule adopted by the Judicial Conference of the United States and shall be exempt from the payment of fees for access via PACER to the electronic case files maintained in this Court for the above-captioned case. Counsel is directed to open a separate PACER account to be used only for the above-captioned case. Fees are exempt for this case only. Counsel shall not be exempt from the payment of fees incurred in connection with other uses of the PACER system in this Court. This exemption is valid for the duration of counsels participation in this matter and may be revoked at the discretion of the Court at any time. Counsel shall contact the PACER Service Center at 1-800-676 6856 or via the link below to create the new PACER account and to make any necessary arrangements for the waiver. But the Court will not obtain copies of Plaintiff's trust fund statements for him. Plaintiff also is reminded that he must submit trust fund statements showing activity in his accounts from 09/18/2018 to 03/18/2019, along with a renewed, certified, and properly completed application if he wants the Court to reconsider whether he may proceed without prepaying the filing fee. By 06/12/2019, Plaintiff must either (1) submit a properly completed application that is certified by a trust fund officer and that includes a copy of Plaintiff's trust fund statements showing all transactions in his accounts for the entire six-month period immediately before the filing of the complaint; or (2) pay the full statutory filing fee of $400.00. Failure to comply with this order will result in summary dismissal of this case. Plaintiff's request that this Court reconsider its denial of counsel is denied without prejudice; there still is no reason, yet, to recruit counsel at this early stage of the case and when the filing-fee status must be determined.
