Filing 9 SUPPLEMENT to Notice of Removal (Bode, Anne) |
Filing 8 MINUTE entry before the Honorable Ronald A. Guzman: This is an action removed from state court by defendant Mitsubishi Electric U.S., Inc. on the ground of diversity jurisdiction. Mitsubishi's allegations of plaintiff's citizenship, however, are deficient. The Notice of Removal states: "Plaintiff is a resident of Cook County, Illinois. Therefore, Plaintiff is a citizen of the State of Illinois." (ECF No. 1, Notice of Removal, at 2.) Residence and citizenship, however, are not synonymous; an individual's citizenship depends on domicile, not residence. Camico Mut. Ins. Co. v. Citizens Bank, 474 F.3d 989, 992 (7th Cir. 2007); Myrick v. WellPoint, Inc., 764 F.3d 662, 664 (7th Cir. 2014) ("Citizenship means domicile (the person's long-term plan for a state of habitation) rather than just current residence."). Accordingly, Mitsubishi shall file a jurisdictional supplement curing this deficiency no later than January 13, 2020, or the case will be remanded to state court for lack of jurisidiction.
