ORDER: Plaintiff's application for leave to proceed in forma pauperis [R. 3] is granted pursuant to 28 U.S.C. 1915(g)'s "imminent danger" exception. The Court waives the initial partial filing fee pursuant to 28 U.S.C. 1915(b)(4), but authorizes and orders the trust fund officer at Plaintiff's place of incarceration to begin collecting monthly deductions in accordance with this order toward payment of the statutory filing fee. Plaintiff's trust fund officer must collect 100% of all income into his trust account until accrued filing fees are paid. The Court directs the Clerk to send copies of this order to the Court's Fiscal Department, and to the trust account office at Plaintiff's place of confinement. However, summonses shall not issue at this time. The Court on its own motion requests that Gary R. Clark / Quarles & Brady LLP / 300 N. LaSalle Street, Suite 4000 / Chicago, Illinois 60654 / (312) 715-5000 / gary.clark@quarles.com represent Plaintiff in accordance with counsel's trial bar commitment under Local Rule 83.37 (N.D. Ill.). The complaint on file is dismissed without prejudice to Plaintiff's counsel filing an amended complaint by 8/24/2020, assuming counsel can do so consistent with his obligations under Rule 11 of the Federal Rules of Civil Procedure. The amended complaint must be limited to issues involving imminent danger of serious physical injury. Recruited counsel falls within the class of users listed in the Electronic Public Access fee schedule adopted by the Judicial Conference of the United States; therefore, counsel shall be exempt from the payment of fees for access via PACER to the electronic case files maintained in this court for the above-captioned case, as well as for Case Nos. 02 CV 4363 (N.D. Ill.), 02 CV 6499 (N.D. Ill.), 03 CV 1429 (N.D. Ill.), 04 CV 7765 (N.D. Ill.), 06 CV 0018 (N.D. Ill.), 06 CV 5247 (N.D. Ill.), 07 CV 0814 (N.D. Ill.), 07 CV 50053 (N.D. Ill.), 07 CV 4855 (N.D. Ill.), 07 CV 6936 (N.D. Ill.), 07 CV 7061 (N.D. Ill.), 08 CV 1777 (N.D. Ill.), 14 CV 5552 (N.D. Ill.), and 18 CV 50193 (N.D. Ill.). The Court instructs recruited counsel to open a separate PACER account to be used only for the above-captioned cases, and fees are exempt for these cases only; he shall not be exempt from the payment of fees incurred in connection with other uses of the PACER system in this court. This exemption is valid immediately and for the duration of counsel's participation in the matter. This exemption may be revoked at the discretion of the Court at any time. Counsel shall contact the PACER Service Center at 1-800-676 6856 or via the link below to create the new PACER account and to make any necessary arrangements for the waiver.
