Tharp, Jr on 9/25/2020: By order dated August 18, 2020, the Court denied Plaintiff's application for leave to proceed in forma pauperis without prejudice and ordered him to either submit a properly completed and supported application or pay the Court's $400.00 filing fee #6 . At that time, the Court warned Plaintiff that failure to comply by September 15, 2020, would result in summary dismissal of this case. Plaintiff failed to comply with the order. Filing 6 ORDER: The Court denies Plaintiff's application for leave to proceed in forma pauperis #3 without prejudice. If Plaintiff wants to proceed to screening under 28 U.S.C. 1915A, he must either (1) prepay the full statutory filing fee of $400.00; or (2) submit a renewed application to proceed in forma pauperis that complies with the instructions in the statement section of this order. Failure to comply by September 15, 2020, will result in summary dismissal of this case. Plaintiff also must promptly submit a change-of-address notification if he is transferred to another facility or released. Failure to keep the Court informed of his address may lead to dismissal of this case for failure to comply with a Court order and for want of prosecution. The Court defers ruling on Plaintiff's motion for attorney representation and initial review of his complaint until his fee status has been resolved. The Court directs the Clerk of Court to send Plaintiff a blank application to proceed in forma pauperis along with a copy of this order. Signed by the Honorable John J. Tharp, Jr on 8/18/2020.
