Date Filed Document Text
October 20, 2020 Filing 8 APPLICATION by Plaintiff Andrew McHaney for leave to proceed in forma pauperis. (Attachment) (Envelope postmarked 10/15/2020) (lma, )
October 16, 2020 Opinion or Order Filing 7 ORDER: On September 30, 2020, the Court denied Plaintiff's application for leave to proceed in forma pauperis #3 and ordered him, by October 29, 2020, to either submit a completed in forma pauperis application that complies with the below instructions, or pre-pay the full $400 filing fee. Plaintiff, in a letter that predates the Court's order, asks whether he has "been given an attorney to represent [his] case yet." #6 Attorney representation is not automatic, and the Court declines to recruit counsel for Plaintiff at this stage. His requests for attorney representation #4 #6 , which show that he has made only one effort to obtain counsel on his own, are denied. See Pruitt v. Mote, 503 F.3d 647, 654-55 (7th Cir. 2007) (en banc); Russell v. Bukowski, 608 Fed. App'x 426, 428(7th Cir. 2015) ("[B]efore a district court is required to consider recruiting counsel to assist a litigant in a civil case, the litigant must make a reasonable attempt to secure counsel for himself."). Plaintiff should make additional efforts to obtain counsel by writing to attorneys and legal organizations, describing his intended claims, and seeking representation. Even had Plaintiff made sufficient efforts, he is a high school graduate, and his submissions suggest that he, like most inmates, is capable of completing the next steps the Court directed in its last order without the assistance of an attorney. The Court on its own motion extends the date for Plaintiff to comply with the last order to November 13, 2020. The Clerk of Court is directed to send Plaintiff a copy of the Court's order of September 30, 2020, along with an application for leave to proceed in forma pauperis, and a copy of this order. Signed by the Honorable John J. Tharp, Jr on 10/16/2020. Mailed notice (lma, )
October 16, 2020 MAILED a copy of the Court's order of September 30, 2020, along with an application for leave to proceed in forma pauperis, and a copy of order #7 to Plaintiff. (lma, )
October 2, 2020 Filing 6 LETTER from Andrew McHaney dated 9/28/2020. (Envelope postmarked 9/28/2020) (lma, )
September 30, 2020 Opinion or Order Filing 5 ORDER: Plaintiff's application for leave to proceed in forma pauperis #3 is denied because it is incomplete. By October 29, 2020, Plaintiff must either: (1) submit a completed in forma pauperis application that complies with the below instructions; or (2) pre-pay the full $400 filing fee. If Plaintiff fails to comply with the foregoing instructions by that date, this case will be summarily dismissed. The Court defers ruling on Plaintiff's motion for attorney representation and initial review of his complaint until his fee status has been resolved. The Clerk of Court is directed to send Plaintiff an application for leave to proceed in forma pauperis, along with a copy of this order. Signed by the Honorable John J. Tharp, Jr on 9/30/2020. Mailed notice (lma, )
