Filing 6 ORDER: By order dated November 20, 2020, the Court denied Plaintiff's application for leave to proceed in forma pauperis and ordered him to pay the Court's $400.00 filing fee #5 . The Court warned Plaintiff that failure to pay the fee by December 18, 2020, would result in dismissal of this case. Plaintiff has not paid the fee or otherwise responded to the order to date. Accordingly, this case is summarily dismissed. Plaintiff's motion for attorney representation #4 is denied as moot. Case closed. Signed by the Honorable Robert W. Gettleman on 12/28/2020. Filing 5 ORDER Signed by the Honorable Robert W. Gettleman on 11/20/2020: Plaintiff's application for leave to proceed in forma pauperis #3 is denied because he has struck out under 28 U.S.C. 1915(g). If Plaintiff wants to proceed with this lawsuit, he must prepay the full statutory filing fee of $400.00. He may pay by check or money order made payable to Clerk, United States District Court. Failure to remit the filing fee by December 18, 2020, will result in summary dismissal of this case. The Court previously warned Plaintiff that he must disclose the fact that he has accumulated three "strikes" under section 1915(g) when filing a new federal lawsuit. See Carter v. McCloud, No. 20 C 5844 (N.D. Ill.), at Dkt. 5. He did not do so when initiating this action. His failure to prepay the filing fee when initiating new lawsuits (or to disclose the fact that he has "struck out" when applying for leave to proceed in forma pauperis) will result in immediate dismissal of the newly filed action with prejudice. See Sloan v. Lesza, 181 F.3d 857, 858-59 (7th Cir. 1999). Mailed notice (cn). |
