MAILED blank IFP application (non-prisoner) to Felton Williams (daj, ) |
Filing 6 ORDER Signed by the Honorable Andrea R. Wood on 5/10/2021: Based on his recent address change #5 and a search of the IDOC website, it appears Plaintiff is no longer incarcerated. Given his apparent release, the Court denies his in forma pauperis ("IFP") application #3 without prejudice because it does not account for his post-release financial situation. If he wishes to proceed with this case, Plaintiff must submit an updated IFP application showing his current financial and employment status. See Robbins v. Switzer, 104 F.3d 895, 898 (7th Cir. 1997) (a plaintiff remains obligated to pay the filing fee under the Prison Litigation Reform Act even after his release from incarceration, and a court must assess his current ability to pay). Any renewed IFP application must be signed and contain accurate information regarding his current financial situation. As detailed on the form that the Clerk will provide, Plaintiff must disclose all assets and income that he received in the past twelve months so the Court can determine how he is supporting himself (for example, with public assistance, new employment, assistance from family, or other means). In submitting the renewed application, Plaintiff must make a good faith effort to answer all the questions to the best of his ability and must provide an accurate picture of how he is obtaining the basic necessities of life. Plaintiff need not include a certificate from an authorized officer or a copy of his prison trust fund account with his new application. In the alternative, Plaintiff may pay the statutory $402 filing fee. Failure to comply with this order by 6/21/2021 will result in summary dismissal of this case. The Clerk of Court shall send this order and a blank IFP application (non-prisoner) to Plaintiff. The Court defers its review of Plaintiff's complaint until his fee status is resolved.
