Non-Party Andrew Lee Flowers, Jr.'s Motion to Quash Subpoena For Deposition #1 is entered and continued to 4/11/22 at 9:30 a.m. As discussed on the record during today's hearing, if Plaintiff and the County Defendants' Motion for a Good Faith Finding filed in a related case (ECF No. 151 in DiMaio v. Hain, et al., Case No. 19-cv-6613) is granted, then Plaintiff DiMaio may be withdrawing his subpoena for the deposition of movant Andrew Lee Flowers and Flowers's Motion to Quash #1 will be moot or withdrawn. If the Court needs to decide the Motion to Quash #1 , then the Court would like Plaintiff DiMaio to file a brief that addresses (1) whether a subpoena issued out of the Northern District of Illinois for the Zoom deposition of Flowers who resides in the Eastern District of Missouri is a validly issued subpoena under Federal Rule of Civil Procedure 45, and (2) whether Flowers has waived any argument that the subpoena is invalid by not raising that argument in his Motion to Quash #1 . Movant Flowers shall then respond to Plaintiff DiMaio's filing seven days thereafter. The Court will set that briefing schedule once it is clear it needs to rule on the Motion to Quash #1 .
