Kness: On April 6, 2023, the Court entered an order #20 adopting the parties' proposed schedule (see Dkt. #19 ) and directing the parties to submit a proposed scheduling order. Among other dates, the parties proposed (and the Court adopted) a fact discovery cutoff of October 2, 2023 and a dispositive motions deadline of March 1, 2024. The April 6 order also noted that "the fact discovery cutoff date is a governing deadline and that no extensions of this deadline will be granted absent a showing of good cause." At a status hearing held on May 1, 2023, the Court reaffirmed that it was adopting the parties' proposed schedule and revisited the issue of a proposed order setting forth that schedule in writing; but, again, the schedule was adopted and became effective on April 6. After some back and forth on the docket about whether the parties ever submitted a proposed scheduling order (such orders are beneficial because they allow the Court to rapidly locate the governing schedule on the docket), the parties eventually submitted a proposed scheduling order by email on October 17, 2023. In reviewing the proposed order, the Court has discovered that the schedule in that document does not match the schedule adopted on April 6. More precisely, the schedule on the proposed order bears a fact discovery cutoff of June 5, 2024 and a dispositive motions deadline of December 18, 2024. That latter date is fully nine and a half months later than what the Court adopted, but no party has filed any motion to extend the previously-adopted case management deadlines. In view of the foregoing, an in-person status hearing is set for 10/25/2023 at 10:20 AM. Lead counsel are directed to appear and must be prepared to explain whether the erroneous dates set forth in the proposed order are the product of mere inadvertence, or whether the parties instead sought to amend the schedule previously adopted by the Court without explicitly having sought leave to do so.
